The former Ministry of Foreign Trade and Economic Cooperation released Announcement No.15, 2000 on Dec 18, 2000, deciding to carry out final anti-dumping measures on imported cold rolled stainless steel sheet originated form Japan and South Korea (hereinafter referred to as “investigated commodity”). The anti-dumping duty rate on NIPPO YAKIN KOGYO CO., LTD was decided to be 27 percent. DAIHAN ELECTRIC WIRE CO., LTD signed commitment agreement on price with the former Ministry of Foreign Trade and Economic Cooperation.

On Apr 8, 2006, Ministry of commerce released Announcement No 18, 2006, deciding to uphold the original anti-dumping measures on commodities decided in Announcement No.15, 2000 of the former Ministry of Foreign Trade and Economic Cooperation, the duration of which shall be 5 years.

NIPPO YAKIN KOGYO CO., LTD and DAIHAN ELECTRIC WIRE CO., LTD submitted applications to Ministry of Commerce in December 2006 and June 2007 respectively, claiming that YAKIN KAWASAKI CO.,LTD succeed anti-dumping duty rate of NIPPO YAKIN KOGYO CO., LTD, and DAIHAN ST CO.,LTD succeed rights and obligations under the price commitment of DAIHAN ELECTRIC WIRE CO., LTD.

Ministry of Commerce informed the original applicant of anti-dumping investigation of related issues, who represented the domestic stainless steel industry, did not make any comments.

In line with examination, Ministry of Commerce believes that the current evidences approve that YAKIN KAWASAKI CO.,LTD, first as KAWASAKI Manufactory affiliated to NIPPO YAKIN KOGYO CO., LTD, is sole subsidiary of NIPPO YAKIN KOGYO CO., LTD. YAKIN KAWASAKI CO.,LTD inherited all production equipment of the KAWASAKI Manufactory and grew to be independent legal person specializing in stainless steel production with materials supply, client relations and producing capacity unchanged. DAIHAN ST CO.,LTD, first as Anshan division of DAIHAN ELECTRIC WIRE CO., LTD, is sole subsidiary of DAIHAN ELECTRIC WIRE CO., LTD. DAIHAN ST CO.,LTD inherited all production equipment of the Anshan division and grew to be independent legal person specializing in stainless steel production and sales with materials supply, client relations and producing capacity unchanged.

As from release of this Announcement, Ministry of Commerce decides that YAKIN KAWASAKI CO.,LTD succeeds the rights and obligations of stainless steel anti-dumping measures of NIPPO YAKIN KOGYO CO.,LTD. Chinese Customs shall impose an anti-dumping duty of 27 percent on investigated commodity from YAKIN KAWASAKI CO.,LTD, and 58 percent, an anti-dumping duty rate on “other Japanese companies” on investigated commodity from NIPPO YAKIN KOGYO CO.,LTD. DAIHAN ST CO.,LTD shall succeeds the rights and obligations of DAIHAN ELECTRIC WIRE CO.,LTD in price commitment agreement. Chinese Customs shall impose hall impose an anti-dumping duty of 57 percent on investigated commodity from DAIHAN ELECTRIC WIRE CO.,LTD, which is equal to anti-dumping duty rate of “other companies of South Korea”.
