Mesa wins injunction against Delta

Mesa Air Group has won a preliminary injunction in the Federal Court in Atlanta to block Delta Air Lines from terminating its Freedom Air contract, the company announced.

Delta had notified Mesa in March that it wanted to terminate its Delta Connection agreement because of Mesa's failure to maintain a specified completion rate through Freedom Airlines.

"We are pleased with the court's ruling," said Mesa chairman and CEO Jonathan Ornstein. "We wish to reaffirm our commitment to provide the very best service to Delta Air Lines, our passengers and our people. We are hopeful this issue can be fully resolved soon."

Phoenix-based Mesa has said that the company might have to file for bankruptcy if it loses the regional carrier contract. Mesa said Delta accounts for as much as 20 percent of its annual revenue.

Also on Thursday, Mesa said it has received notice from Nasdaq that it risks delisting for failing to file its 10-K.

Mesa (Nasdaq: MESA) so far has not filed its 10-Q for the quarter ended March 31. The company announced two weeks ago that it had delayed the filing until June 2.

Mesa said it plans to request a hearing before a Nasdaq listing-qualifications panel.

The company said that it expects to meet the projected filing date, which will precede its hearing.
