Korean Air denies Australian watchdog's right to seize its papers

KOREAN AIR has instructed lawyers to block the Australian Competition and Consumer Commission in Federal Court from obtaining sensitive documents in connection with the investigation into price-fixing by international airlines.

Korean Air argues through its law firm Clayton Utz that the local competition watchdog has no right to demand confidential documents or raid its offices, reported The Sydney Morning Herald.

The airline also argues it does not have to submit documents because the commission has already started its prosecution for alleged breaches of competition law.

In August, Korean Air paid a US$300 million criminal fine when it entered into a plea bargain with US Justice Department.
